За подкупа

Действията на даващия („активен подкуп“) и приемащия („пасивен подкуп“) са юридически самостоятелно урегулирани, тъй като имат различна обществена опасност.
При престъплението подкуп има корелация между „активния“ и „пасивния подкуп“, налице е „необходимо съучастие“ между двете страни и съвпадане на волята им за реализиране на корупционната сделка.
За „пасивния подкуп“ отговарят длъжностните лица по чл. 93, т. 1 НК.

Непосредственият обект на подкуп са онези обществени отношения, които възникват във връзка със законосъобразното и безкористно осъществяване на дейността на длъжностните лица.
По-голямото разнообразие на квалифицирани състави на “пасивния подкуп“ обуславя по-голямата му обществена опасност за корумпирането на обществено значимия длъжностен апарат.
Решаващо при тези деяния е не толкова размерът на облагата, нейното трайно или временно значение за имуществото на длъжностното или трето лице, колкото съвкупният вредоносен резултат за функционирането и авторитета на службата на длъжностното лице.
Подкупът е едно от най-тежките престъпления, насочени срещу дейността на държавните органи, обществени организации и лица заемащи публични длъжности, за който е отреден Раздел IV от Глава осма на Наказателния кодекс.
 Изпълнително деяние
„Пасивният подкуп“ е двустранна престъпна дейност, при която
длъжностно лице получава дар или каквато и да е облага, услуга за действие или бездействие, които не му следват, срещу престиране на определено деяние или поведение, желано от „дарителя“.
Изпълнителното деяние на „пасивния подкуп“ може да се прояви под четири различни форми:
1. Поискване на неследващ дар или облага, посредством волеизявление, с което длъжностното лице изявява желание да получи подкуп;
2. Приемане на неследващ дар или облага от длъжностното лице;
3. Приемане на обещание за неследващ дар или материална облага. Приемането може да се извърши и от трето лице;
4. При приемането на предложението за дар или материална облага е налице съгласие от длъжностното лице с направеното предложение за предоставяне на предмета на престъплението.
При всички тези случаи, длъжностното лице прибавя актив към своя икономически статус, за който няма правно основание.
Подкупът е резултатно престъпление – имуществото на дееца се увеличава, заличава се пасив/задължение на дееца или получаване на услуга, която не му следва.
Не е задължително, длъжностното лице непременно да заема ръководна длъжност, но престъпното деяние трябва да е в рамките на задълженията му по служба. Ако деянието няма връзка с неговата служба, то не е налице подкуп, а извършване на извънслужебни услуги срещу заплащане.
Както се вижда от т. 3 и т. 4, деянието може да не е реализирано, а е
достатъчно да се приеме обещание или предложение за престация на дар или облага.
 Подкупът – сделка между насрещни страни
В съдебната практика отдавна се е наложила тезата, че подкупът е двустранна сделка, подобна на дарение с тежест (donatio sub modo), която обаче противоречи на закона и затова е нищожна.
Като юридически факт, вследствие волеизявлението на страните, сделката е източник на правоотношение. При формирането и, действа автономия на волята на страните. Освен воляизявлението, фактическият състав на сделката може да съдържа и други елементи (conditio juris): действия, събития и срокове. Те обаче не влияят на съдържанието на сделката, а на нейното проявление и реализация.
Разликите между дарението и подкупа се състои най-вече в намерението – при дарението това е акт на добронамереност, щедрост, докато при подкупа водещо е користта и алчността.
Подкупът е двустранна, консенсуална сделка. За да възникнат желаните последици, необходимо е изразяването на волята на две насрещни страни. Без наличието на предложение от едната и приемане и от другата страна, няма валиден договор.
Важно е да се отбележи, че подкупът е нищожна сделка, тъй като е в противоречие на закона.
 Пряк умисъл
При подкупа, даващият трябва да е със съзнанието, че престира дар на длъжностно лице, че този дар не му следва, за да извърши или неизвърши търсеното действие по служба или защото е извършило или неизвършило вече такова действие.
Ето защо, при подкупа по чл.301, ал.1 НК трябва да има формиран пряк умисъл както у даващия, така и в длъжностно лице, получаващо неследващата му облага.
Ако липсва съзнанието в даващия, че престира подкуп, не може да се заключи, че в длъжностното лице е възникнало усещането, че с приема на подкупа се осъществява престъпния състав на чл.301, ал. 1 НК.
При „пасивния подкуп“ формата и вида на вината е винаги пряк умисъл с изявен користен мотив, но не и с користна цел, което го отличава от престъпленията с користна цел.
